Cornell Investigation and Proactivity in Justice

 When we look at this news report, we should consider the needs of the sexual assault victims. If the allegations are accurate, they may have experienced a horrific event, and others may have reported similar conduct without prompting an investigation. Time will answer. There is room for improvement that creates stronger deterrence and investigations.

Prosecutors have limited time and resources, but when victims must do much of the work before action is taken, we should ask whether the system is effectively delivering justice. Case filings can help but shouldn't be the investigation core because not all victims feel safe to speak up. There is systemic and individual room for adjustment but we are often unsure of what that improvement would look like. 

This is where politics, perception, sometimes bigotries and fierce debates heat up. What changes.....

This connects with our Allegory of the Clan, a hypothetical thought experiment examining a situation where people in a community were trying to protect sexual assault victims, minorites, others and respectfully challenged ongoing immunities for embedded closed system corruption and openly court sponsoring of organized hate. Instead of doing the right thing victims were ignored, witnesses targeted, and whistleblower information shared with perpetrators for violent and illegal retaliation. The benefits of being in an in group. A travesty of justice when the victims needed to do the work of tax payer funded prosecutors; and at a higher level of integrity. As can be expected, when checks and balances are weak in what appears to be neglectful-victim dumping and blaming.

A healthy justice system should have the resources and qualified people needed to investigate credible allegations, evaluate evidence, protect victims, and apply the law fairly. Ensuring equal access to justice and protecting everyone’s constitutional rights remains an important challenge for society. Supporting good officials and improving effectiveness is helpful.  Correcting wrongdoing should not be optional for judges who might not have a full understanding of the essential purpose of institutions. Trust is declining and situations like this don't help. It is not worth damaging the whole to advantage a few. 

When reasonable complaints are made it should not be the victims that do the work we already pay taxes for. Patterns are emerging highlighting the need for reform. Its a choice over who we elect and promote in our institutions.  The end result we all own, whether some of us are seen as first or second class citizens.

Time will answer so hold full judgment.

Cornell Sexual Assault Investigation Reopened
